15.11 Section II General Conditions
The following conditions apply to the coverages provided under Section II.
Bankruptcy
The insured's bankruptcy or insolvency does not relieve the insurer of its obligations under the policy.
Duties in the Event of Occurrence, Offense, Claim, or Suit
The insured must notify the insurer as soon as practicable of any occurrence or offense that may result in a claim. The notice should include:
- How, when, and where the occurrence or offense took place.
- The names and addresses of any injured persons and witnesses.
- The nature and location of any injury.
If a claim or lawsuit is filed, the insured must record the details, including the date, and notify the insurer as soon as practicable. The insured must also:
- Immediately send the insurer copies of all demands, notices, summonses, and other legal documents.
- Authorize the insurer to obtain records and other relevant information.
- Cooperate with the insurer during the investigation, settlement, or defense of the claim.
The insured must not voluntarily make payments or incur expenses without the insurer's consent, except for first aid. Any unauthorized payment or expense is the insured's responsibility.
Legal Action Against Us
All policy conditions must be met before any person or organization can bring a lawsuit against the insurer.
Separation of Insureds
Except for the limits of insurance and duties assigned specifically to the named insured, the policy applies separately to each insured against whom a claim or lawsuit is brought.
